The case was decided by the lower courts. There is no way that the corrupt SCOTUS should have done anything but decline taking it on. Other cases would have been delayed, but it would have been a precedent and at least the country would have heard that tRUMP really did partake in an insurrection, was liable for his actions, that he did NOT have total immunity and that he was not above the law. It would have also weakened his defense in future cases.
Arguing for the US government is Michael Dreeben. A well respected lawyer with credentials that include this being his 100th case before the Supreme Court. https://www.scotusblog.com/2019/08/michael-dreeben-a-true-public-servant/
Arguing for LOSER45 is John Saeur, who was likely chosen for his ability to be grating, repetitive and deceptive and thinks fRUMP might be immune from shooting anyone on 5th Ave., including rivals as long as he was president... and today, he also said he could instigate a coup...no problems... before saying "if it was an official act." They met before...
Emptywheel (Marcy Wheeler) did a thread commentary here: https://threadreaderapp.com/thread/1783497429750321272.html
The justices were dismissive of the government, not letting him answer their questions and talking over him,,,, and asking new questions without getting the answer to the last one. And there was so much circular repetition!
Most disconcerting was hearing Kavanaugh, who was a go between for lawyers in the Clinton trials passing on notes to the press about which direction his penis leaned, suddenly being just fine with actual REAL crimes being committed by their boy... in or out of office. https://www.esquire.com/news-politics/politics/a22638554/brett-kavanaugh-vince-foster-investigation/
I am not a lawyer, so I will refrain from commenting too much on what happened today, other than to say a tear welled up listening to the arguments... because YOU IN DANGER AMERICA! As are we. tRUMP will be on our doorstep demanding we kowtow to his demands ... or even worse, being he said Putin can do whatever he wants, let Russia claim our resource rich northern territories and who knows what else. If he gets his way, nothing can stop him.
Here are some excerpts
Listening to the tRUMP lawyer saying a president is immune as staging a coup is an official act... and could be, if it is... maybe. YOU DECIDE...
Justices ask government which 'core powers' are covered by presidential immunity (Kavanaugh likes beer)
Jackson asks what stops presidents from committing crimes if they're immune from prosecution.
It's not a crime when the president does it!
Government lawyer says Trump organizing alternate electors was ‘campaign conduct’ and NOT "official" duties.
Or you can listen to other talking heads... for a summation
Or read here: this is what the Supreme court watchers who are focused on SCOTUS a LOT say:
Supreme Court appears likely to side with Trump on some presidential immunity
Well, of course they will. But the question is, being they promised to come up with absolutes so that in the future no one need ask (yeah sure... nearly everyone agrees they will punt it back to the lower courts to delay, delay, delay just like the Mobster wannabe requested) to what extent will they dip their thumbs onto the scales of justice? And how long will it take? And why are they governing from the bench? And why the F is Thomas even allowed to sit in on the case, when his wife was an instigator and should be investigated herself?
They can't even make a decision on whether a crime is a crime unless the term president is named in the criminal act... or whether he is an official because a tRUMP judge misinterpreted a law to favour tRUMP... so what ARE his "official" duties? The law is an ass. I respect these people protesting far more...
